By accessing or using services provided by Berry Limitless, Inc. (“Berry Limitless,” “EMPIRE,” “we,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Berry Limitless provides:

• Online fitness coaching and transformation programs
• AI-powered coaching tools and recommendations
• Marketing and business growth consulting
• Wealth education and financial planning resources
• Community membership and networking
• Digital content including videos, guides, and training materials

You must be at least 18 years old to use our services. By using our services, you represent that you meet this requirement. If you are under 18, you may only use our services with verifiable parental consent.

Billing

Subscription fees are billed in advance on a monthly basis. All fees are in USD. By providing payment information, you authorize us to charge the applicable fees each billing cycle.

Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial periods unless required by applicable law.

Refund Policy

We offer a 7-day satisfaction guarantee on new subscriptions. If you are not satisfied within your first 7 days, contact us and we will make it right. After 7 days, all sales are final. Digital content is non-refundable once accessed.

IMPORTANT: Berry Limitless provides fitness coaching and educational content for informational purposes only. Our services are not a substitute for professional medical advice, diagnosis, or treatment.

Before beginning any new exercise or nutrition program, consult a qualified healthcare provider, especially if you have existing health conditions, injuries, or take medications. You participate in our fitness programs at your own risk.

Financial content provided through EMPIRE's Wealth Division is for educational purposes only and does not constitute personalized financial, investment, tax, or legal advice. Berry Limitless is not a registered investment advisor. Always consult qualified professionals for financial decisions.

You agree not to:

• Share your account credentials with others
• Reproduce, distribute, or resell our content without permission
• Use our services for any unlawful purpose
• Harass, abuse, or harm other community members
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or collect our content

All content on our platform — including workout programs, videos, AI-generated plans, text, graphics, and software — is owned by or licensed to Berry Limitless. You may not copy, modify, distribute, or create derivative works without our written consent.

You retain ownership of content you create and share through our platform. By sharing content, you grant us a non-exclusive license to use it to provide and improve our services.

Our community platforms require respectful conduct aligned with our Faith · Family · Fitness values. We reserve the right to remove content and suspend or terminate accounts that violate our community standards, including:

• Discrimination, hate speech, or harassment
• Spam or unsolicited promotion
• Sharing of misleading health or financial information
• Violation of any member's privacy

We reserve the right to suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your right to access our services ceases immediately. Subscription fees will not be refunded upon termination for cause.

To the fullest extent permitted by law, Berry Limitless shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms at any time. We will provide 30 days' notice for material changes via email or in-app notification. Continued use after the effective date constitutes acceptance.

Berry Limitless uses artificial intelligence (referred to on our platform as “EMPIRE AI”) to power certain features, including workout and nutrition recommendations, coaching plan personalization, and automated messaging support. AI outputs are generated based on the information you provide and general fitness and wellness data — they are not a substitute for individualized medical, nutritional, or professional advice.

Every member is also paired with a real, human coach. AI-generated recommendations may be reviewed, adjusted, or overridden by your coach at any time. If you have a medical condition or specific health concern, consult a qualified healthcare provider before following any AI-generated or coach-provided recommendation.

Berry Limitless operates an affiliate and referral program. Members, coaches, and approved affiliates may share a personal referral link and earn a commission on purchases made through that link. In accordance with FTC guidelines, any content promoting Berry Limitless through a referral or affiliate link should be clearly disclosed as such by the person sharing it (for example, “I earn a commission if you sign up through this link”).

Referral commissions do not affect the price you pay. Berry Limitless does not control or pre-approve affiliate marketing content and is not responsible for claims made by individual affiliates that go beyond what is stated on this website.
